AMlink Privacy Agreement

Introduction

AMlink Technologies, LLC. (hereinafter referred to as "AMlink" or "we") takes your privacy very seriously. AMlink is a platform provided by AMlink to control and manage your AMlink smart devices.

This Privacy Policy has been developed with your needs in mind, and it is important that you fully understand our personal information collection and use practices while ensuring that you have control over the personal information you provide us. This Privacy Policy sets out how we collect, use, disclose, process, and store the information you provide us with when you are using the app. "Personal Information" in this Privacy Policy refers to data that can identify a specific individual through the information itself or association with other information. We will use this information strictly under this Privacy Policy.

I. What information do we collect and how we use it

A. You must authorize us to collect and use your personal information

The purpose of collecting personal information is to provide you with products and/or services and ensure that we comply with applicable relevant laws, regulations, and other normative documents. You have the right to choose whether to provide this information, but in most cases, if you do not provide it, we may not be able to provide you with corresponding services or respond to issues related to your service. These functions include:

1. Smart Device Connection

To provide you with the ability to safely connect and manage your devices, we may collect Wi-Fi information such as the IP address, location information, login account information, mobile phone-related information, device-related information, AMlink account, and any device-related information. This information will be used to provide you with functions such as fast connection, connection, find nearby devices, and device management. The above information is listed in detail as follows:

  • Account information. Your AMlink account ID, nickname, and avatar information.
  • Device Information. Hardware device identification (IMSI, IMEL, MEID, device serial number, SIM card identification, OAID, MAC address, Android ID), mobile phone model, system version information, system language, country or region where the mobile phone is set, the version number of the application store, mobile screen size and resolution, CPU and display device-related information.
  • Information collected while connecting smart devices. Based on the type of smart devices you need to link; we may collect the following information: Smart devices connected via Wi-Fi: Wi-Fi information (SSID, BSSID, Wi-Fi MAC address, Wi-Fi password), MAC address, device ID.
  • After establishing a local connection through Bluetooth, smart devices are connected through Wi-Fi: Wi-Fi information (SSID, BSSID, Wi-Fi MAC address, Wi-Fi password), device MAC address, device Bluetooth MAC address.
  • Smart devices connected via Bluetooth: MAC address and device ID.

2. Home Management of AMlink Devices

To create a better experience, we may collect information about the layout of your rooms from your devices. This allows you to easily manage your connected devices and personalize automations for maximum convenience.

3. Device Sharing

We encourage you to share your AMlink device with others through your AMlink account. After sharing your device, the shared user can also have access and control of the device. We may collect your account ID, the shared account ID provided by you, and the shared device information (device ID, device name, and device sharing status), which is used to provide you with the ability to share the device to other AMlink account users for general control, use and to display the sharing status on the device list page.

4. Application and Hardware Upgrades

To provide you with the latest service, we may require the information version of your AMlink application and your mobile phone model information. At the same time, we may collect the list and version number information of any connected devices to provide you with the latest functions of your devices and ensure that you can use the latest version including firmware version.

5. Recommended AMlink products

To have you experience the convenience brought by your AMlink devices, we may use your previously bound AMlink device information to recommend other devices that can link with your devices.

6. Equipment Settings and Functions

We encourage you to set certain rules to link the devices under specific conditions and the app. To enjoy these functions, we may collect your location information, your rule settings for any feature settings, the work and rest time you set, and the device status you specify, to realize the function of executing the device according to the execution command you specify. Rest assured that this function requires you to actively turn on and set rules manually.

7. Content Support (e.g. articles, audio content playback)

To help you better use your devices, we will provide you with selected articles to introduce you to the content related to your specific devices. We will not collect any information from you when reading this content.

If you have connected a device that supports content playback to AMlink, you can select and control the content played by this device on the content support page. We may collect device information bound under your account to provide you with corresponding device controls if needed.

8. Provide value-added service subscription:

To fulfill your orders and ensure your safety, we collect information required by law for anti-money laundering (AML) purposes. This information includes order number, transaction details, and payment methods.

We use this information for several reasons:

  • To verify and complete your transaction: This ensures smooth processing of your purchase.
  • To fulfill your order inquiries and provide customer support: We need this information to answer your questions and assist you with your order.
  • To identify potential trading issues and protect you from fraud: This helps us keep your transactions safe.

Please note: Not providing this information may limit your ability to purchase goods or services but won't affect your use of other platform features.

Regarding Payments: We use a secure third-party payment platform for processing transactions. To complete your payment, we share your order number, transaction amount, payment method, and other AML-required information with the platform.

We are committed to protecting your privacy. We only collect and share information necessary for legal and operational purposes.

9. Notification Service

When you use the notification service, we need to use your Android ID, IMEI, OAID, and IP address to adjust the link, listen to the self-started broadcast of the system, and use the SDK to listen to the uninstallation and installation of the app, promote the closed SDK notification process, and ensure that you can receive the messages we notify in time. If you want to turn off this function, you go to settings – allow the associated startup to send notification messages to configure. Turning off this function does not affect your normal use of this application.

B. You can choose whether to authorize us to collect and use your personal information.

To help you enjoy the control and management of the devices provided by AMlink, we may collect and use your personal information in the following additional functions. If you do not provide this personal information, you can still use the basic services of AMlink, but you may not be able to use these additional convenient functions. These additional features include:

1. Face Recognition Management

If you are connected to a specific product that supports face recognition through the AMlink platform, you can turn on the face recognition function supported by AMlink to have a better overall experience. You can input your facial information so that when we recognize the corresponding facial information, we will mark and push messages to you on the smart device. The face recognition function controls of the device are in Device Settings--Face Recognition Management.

If you have any questions about our identification processes, you can give us feedback to help us optimize the algorithm and model. In this case, we may collect videos of the problems you actively feedback. Please rest assured that the video you feedback will only be used to optimize algorithms and models and will not be used for other purposes.

2. User Feedback

We may collect the feedback questions you sent us, the feedback log, and the telephone number or email you filled in. This information will be used to help us better understand the problems you encounter and contact you if needed.

3. AMlink Authentication Description

The following device permissions may be triggered while you are using AMlink. To better manage your information, we will need your consent to apply for access permission during your device usage, and the details of the permission and the consequences if you choose not to agree will be shown simultaneously. Please check carefully. Before you use specific functions, you can choose whether to authorize the following permissions. At the same time, you can change the authorization status yourself at any time through the device permission settings page.

Permissions List:

  1. External storage space access permission (Android version). Used to read and write photos and files on the device in functions such as scanning and user feedback.
  2. Location permission (Android, IOS version). Used to scan the list of nearby WLAN, search nearby Bluetooth devices, and automatic geofencing in smart scenes; When a user binds a device that does not support GPS, such as a smartwatch, it is used to provide functions such as step frequency calculation, accurate distance recording, and drawing the user's motion trajectory.
  3. Camera permission (Android, IOS version). Used to scan QR codes for device installation, account login, and other functions.
  4. Microphone permission (Android, IOS version). When the user binds the camera, visual doorbell, and other devices in Vidor, it is used for video intercom, voice command pickup, and other functions.
  5. Read phone permission (Android). Used to generate local device ID on the client.
  6. Enable WLAN permission (Android, IOS version). When connecting the device quickly, connect the Wi-Fi sent by the device for device communication.
  7. Enable Bluetooth permission (Android, IOS version). Used to connect the Bluetooth signal sent by the device for device communication when connecting the device. For devices connected through Bluetooth, Bluetooth permission is also required for communication.
  8. Suspended window permission (Android version). When the user binds the camera, it is used to display the real-time picture of the camera in the suspended window.
  9. Message push permission (Android version). When an event alarm occurs, push a message to the user's mobile phone through the message channel.
  10. Software installation list (Android and IOS versions). Used to push and receive messages associated with the launched push service
  11. Modify language configuration (Android and IOS versions). Used to change the language display in the AMlink app if needed.
  12. Accessing Network Status (Android and IOS versions). The efficiency of video communication is optimized by judging the network quality.
  13. Accessing Wi-Fi Status (Android and IOS versions). The efficiency of video communication is optimized by judging the network quality.
  14. Changing Wi-Fi Status (Android and IOS versions). When the network connected to the device sends changes, you need to use this permission to change and configure the Wi-Fi network.

D. You are fully aware that we DO NOT need your consent to collect and use personal information under the following circumstances:

  1. Related to national security and national defense security.
  2. Related to public safety, public health, and major public interests.
  3. Related to the criminal investigation, prosecution, trial, and judgment execution.
  4. To safeguard the life, property, and other major legitimate rights and interests of the personal information subject or other individuals, but it is difficult to obtain my consent.
  5. The personal information collected is disclosed to the public by the subject of personal information.
  6. Your personal information collected from legally disclosed information, such as legal news reports, government information disclosure, and other channels.
  7. Necessary for signing the contract according to your requirements.
  8. It is necessary to maintain the safe and stable operation of the provided products and/or services, such as finding and handling of the products and/or services.
  9. Necessary for legitimate news reporting.
  10. Academic research institutions must carry out statistics or academic research based on the public interest, and when providing the academic research or description to the outside world, they deidentify the personal information contained in the result.

E. Personal Information from a Third party

Under the circumstances permitted by some laws, we may obtain your personal information from a third party. For example, when an event is detected on the premise of your authorization, we may obtain the device status of the device from other smart devices to judge whether to trigger the event or action. You can add or delete the set smart linkage rules under the "smart" page or manage whether to open or delete smart linkage in the page of the smart device.

F. Non-personal Information

We may also collect other information that cannot identify specific individuals (i.e. information that does not belong to personal information), such as statistical data generated when you use specific services, such as user operation behavior (including click, page jump, and browsing time). The purpose of collecting such information is to improve the services we provide to you. The type and amount of information collected depends on how you use our products and/or services. We will summarize such information to help us provide customers with more useful information and understand which parts of our website, products, and services customers are most interested in. For this privacy policy, aggregated data is considered non-personal information. If we combine non-personal information with personal information, such information will be regarded as personal information during the combined use.

II. Cookies and Other Technologies

  • AMlink and third-party service providers use technologies such as cookies, tags, and scripts, which are used to analyze trends, manage websites, track users' website activities and collect statistical information about the whole user group. We will receive individual or summary analysis reports collected through the above technologies. These technologies help us better understand your behavior, enable us to understand which parts of our website users visit, and measure and improve the effectiveness of advertising and web search. Treat information collected through cookies as nonpersonal and other technologies. However, if local laws treat Internet Protocol (IP) addresses or similar identification marks as personal information, we also treat such identification marks as personal information.
  • Logfile: like most websites, we collect specific information and save it in the log file. Such information may include Internet Protocol (IP) address, browser type, Internet service provider (ISP), reference/exit page, operating system, date/time stamp, and/or clickstream data. We will not associate the automatically collected log data with other information we collect.
  • Advertising: we work with third-party service providers displaying advertisements on our website or managing our advertisements on other websites. Our third-party service providers may use technologies such as cookies to collect information about your activities on their websites or other websites and provide advertisements for you based on your browsing activities and interests. We will obtain your explicit consent in advance before providing advertising services to you.
  • Mobile analysis: in some mobile applications, we use mobile analytics software to better understand the functions of our mobile software on your mobile phone. This software may record the following information, such as the frequency of your use of the application, events within the application, cumulative usage, performance data, and the location of application crashes. We will not associate the information stored in the analysis software with any personal information you submit to the mobile application.
  • Local storage - HTML5 / Flash: we use local storage objects (ISO), such as HTML5 or flash, to store content and preferences. According to your web browsing behavior, the third party who cooperates with us to provide some functions or advertise on the website will also collect and store relevant information through HTML5 or Flash cookies. Various browsers provide built-in management tools to delete HTML5 local storage objects.

III. AMlink's Sharing of Personal Data and Transfer Between Third Parties

  • Message notification: If you use other models of mobile phones, SDK will collect your device identifier (IMEI, IDFA, Android ID, IMSI, MAC, and OAID), application information (application crash information, notification switch status, and software list information), device parameters, and system information (device type, device model, operating system, and hardware information). The IP address, Wi-Fi, and base station information are used to push or deliver notification messages.
  • Association start function: when you start the AMlink application, the push service and push service will be associated and started; When the push service and push service are started, the only DOX app push process will be associated and started. The associated push service is used to push and receive messages.
  • Payment function: if you purchase value-added services through the third-party payment channel, the third-party payment service provider will get the storage privileges of your device and collect your unique device identifier (Android ID, IMEI, IMSI).
  • Diagnostic function: com. qiniu SDK needs to check whether the address of the related services can be adequately assessed for faulty location.

IV. Reservation Protocol

We reserve personal information for the period necessary for the information collection described in this privacy policy, or compliance with applicable relevant legal requirements. After completing the collection purpose, or after we confirm your deletion or cancellation application, or after we terminate the operation of corresponding products or services, we will stop retaining personal information and delete or anonymize it. If it is for the public interest, science, historical research, or statistics, we will continue to retain relevant data based on applicable laws, even if further data processing is irrelevant to the original collection purpose.

V. Your Privacy Rights at AMlink

A. Control Settings

We recognize that everyone has different privacy concerns. Therefore, we provide some examples to illustrate the various ways provided by AMlink for you to choose to restrict the collection, use, disclosure, or processing of your personal information and control your privacy settings: turn on or off location access, camera, recording, and reading / writing mobile phone storage permissions.

  • Turn on or off the smart linkage of equipment.
  • Control the face recognition function switch of the product in AMlink "Device Settings-Face Recognition Management".
  • Log in or out of your AMlink account.

B. Rights to your Personal Information

According to the laws and regulations of your applicable country or region, you have the right to request access, correction, and deletion of any personal information related to you held by us (hereinafter referred to as the requested).

For more details related to the personal information in your AMlink account, you can access and change it through your device login account. Most laws require that requests made by personal information subjects should comply with specific requirements, and this privacy policy requires that your request should meet the following conditions:

  • Through our special request channel, and for the sake of protecting your information security, your request should be in writing (unless the oral application is explicitly recognized by local law);
  • Provide sufficient information so that we can verify your identity and ensure that the requester is the subject of the requested information or the legally authorized person.

Once we have sufficient information to confirm that we can process your request, we will respond to your request within the time specified by applicable data protection laws. Specifically:

  • Based on your requirements and applicable laws and regulations, we can provide a record of the personal information we have collected and processed for free. If you make other requests for relevant information, we may charge you a reasonable fee based on relevant applicable laws and combined with the actual management cost.
  • If you believe any information we hold about you is incorrect or incomplete, you can ask to correct or improve your personal information for use.
  • According to your applicable laws and regulations, you may have the right to ask us to delete your data. We will evaluate according to your deletion request. If the corresponding regulations are met, we will take corresponding steps including technical means to deal with it. We have the right to refuse to deal with meaningless/entangled repeated requests, requests that damage the privacy of others, extremely unrealistic requests, requests for disproportionate technical work, requests that do not need to be given according to local laws, information that has been made public and information given under confidential conditions. C. Withdrawal of Consent

D. Cancel Service or Account

If you want to cancel specific products or services, if you want to cancel the account of AMlink, you will not be able to use the products and services due to the cancellation of the AMlink account. Please operate with caution. To protect the legitimate rights and interests of you or others, we will judge whether we support your cancellation request in combination with your use of AMlink's products and services. For example, if there are outstanding installments, we cannot support your request immediately.

Software License and Service Agreement

AMlink Technologies, LLC. (hereinafter referred to as "AMlink") hereby reminds users to read and fully understand this Software License and Service Agreement (hereinafter referred to as "this Agreement"). Users should read and fully understand the terms and conditions of this Agreement, especially the terms and conditions that exclude or limit the liability of AMlink, dispute resolution, and application of the law. The clauses that exclude or limit liability will be marked in bold, and you should read them with emphasis. Please read carefully and choose to accept or not to accept this Agreement (minors should be accompanied by a legal guardian to read this Agreement). Your download, installation, use of the Software and account acquisition and login will be deemed to be acceptance of this Agreement and you agree to be bound by the terms of this Agreement.

AMlink has the right to amend this agreement, and the updated terms and conditions will be published on the official website or software, effective from the date of publication. Users can download and install the software again or check the latest version of the terms and conditions of the agreement on the website. If users do not accept the revised terms and conditions after AMlink has revised this agreement, please stop using the "AMlink" software and services provided by AMlink immediately, and users who continue to use the "AMlink" software and services provided by AMlink will be deemed to have accepted the revised agreement. 1. General Provisions

1.1. This Agreement is an agreement between you (hereinafter referred to as "User") and AMlink and its operating partners (hereinafter referred to as "Partners") regarding the download, installation, and use of AMlink's "AMlink Link" software (hereinafter referred to as "Software") and the use of AMlink's related services. 1.2. The Software and Services are software and services provided by AMlink that are installed on mobile smart terminals, including but not limited to, and provide services such as binding and operating smart products for users using such smart terminals.

2. Software Licensing

2.1. AMlink grants the User a personal, non-transferable, non-sublicensable, and non-exclusive license to the Software.

2.2. The User may install, use, display, and run the Software on a single mobile terminal device for non-commercial purposes. However, the User shall not install, use or run the Software for commercial operation purposes, and shall not copy, change, modify, hook up or create any derivative works of the Software or the data released into the memory of any terminal device during the operation of the Software and the interaction data between the client and the server during the operation of the Software, including but not limited to the use of plug-ins, plug-ins or non-authorized third party tools/services to access the Software and related systems. The software and related systems may be accessed through plug-ins, plug-ins, or unauthorized third-party tools/services. Any commercial sale, reproduction, and distribution, such as pre-installation and bundling of the software, must be authorized and licensed in writing by AMlink.

2.3. Users shall not install the Software on other terminal devices without the express permission of AMlink, including but not limited to set-top boxes, game consoles, TV sets, DVD players, etc.

2.4. The User may make one copy of the Software to use the Software and the Services for backup purposes only. The backup copy must contain all copyright information contained in the original Software.

2.5. Except for the express authorization of this Agreement, AMlink does not authorize other rights to the user, and if the user uses other rights, he/she must obtain separate written consent from AMlink.

3. Software Acquisition, Installation, Upgrade

3.1. Users should download and install this software product according to the designated website or the designated method of AMlink. Beware of downloading the software from non-designated websites to prevent mobile devices from being infected with malicious programs that can destroy user data and obtain user privacy information. If users obtain this software or an installation program with the same name as this software from a third party that is not authorized by AMlink, AMlink cannot guarantee that the software can be used normally and is not responsible for any damage caused to you as a result.

3.2. The user must select the version of the Software that matches the installed terminal equipment; otherwise, any software problems, equipment problems, or damages caused by the mismatch between the Software and the equipment model shall be borne by the user.

3.3. To improve user experience and service content, AMlink has the right to provide you with replacement, modification, and upgrade versions of the Software from time to time and has the right to charge fees for the replacement, modification, or upgrade, but will ask for your consent in advance. Depending on the version of the software used by users, AMlink provides users with the option to choose whether they need to open this function or not. After the new version of the software is released, AMlink does not guarantee the continued availability of the old version of the software.

4. Usage Specifications

4.1. The User may use the Software and Services of this Agreement subject to compliance with the law and this Agreement, and the User shall not commit any of the following acts.

  • 4.1.1. Remove all information about copyright on the Software and other copies, as well as modify, delete or circumvent technical measures set up by the Software to protect intellectual property rights.
  • 4.1.2. Reverse-engineering the Software, such as disassembling, decompiling, or otherwise attempting to obtain the source code of the Software.
  • 4.1.3. Adding, deleting, changing the functions or operating effects of the software by modifying or falsifying the instructions or data in the operation of the software, or operating or disseminating the software or methods used for such purposes to the public, whether these acts are for commercial purposes.
  • 4.1.4. Use the Software for any act that jeopardizes network security, including but not limited to using unauthorized data or accessing unauthorized servers/accounts; accessing public networks or other people's operating systems without permission and deleting, modifying, or adding stored information; attempting to probe, scan, or test the vulnerability of the Software's systems or networks without permission or otherwise committing acts that undermine network security. Attempting to interfere with or disrupt the normal operation of the Software's system or website, intentionally spreading malicious programs or viruses and other acts that disrupt and interfere with normal network information services; forging TCP/IP packet names or partial names.
  • 4.1.5. The user logs in or uses the Software and Services through third-party compatible software or systems not developed, authorized, or approved by AMlink, or makes, publishes, or disseminates the said tools.
  • 4.1.6. Without the written consent of AMlink, the User shall perform the following acts on the Software and the information therein, including but not limited to using, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, setting up mirror sites, developing derivative products, works, services, plug-ins, plug-ins, compatibility, interconnection, etc. with the Software without permission.
  • 4.1.7. Use the Software to publish, transmit, distribute, or store content that violates local laws and regulations.
  • 4.1.8. Use the Software to publish, transmit, distribute, or store content that infringes on the intellectual property rights, trade secrets, and other legal rights of others.
  • 4.1.9. Using the Software to publish, transmit and disseminate advertising information and spam in bulk.
  • 4.1.10. Any other use of the Software and other services provided by AMlink in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the permitted use of this Agreement.

4.2. Information Release Specifications

  • 4.2.1. You may use the Software to publish information content such as opinions, data, text, messages, usernames, images, photographs, personal information, audio and video files, links, etc. that are original to you or that you are entitled to publish. You must ensure that you own the intellectual property rights of the information content you upload or have obtained legal authorization and that any use of the Software and the Services by you does not infringe the legal rights of any third party.
  • 4.2.2. You are required to comply with local laws and regulations when using the Software.
  • 4.2.3. You shall not use the Software to engage in any of the following acts while using the Software, including but not limited to:
    • 4.2.3.1. Produce, reproduce, publish, distribute, or store content that violates local laws and regulations.
    • 4.2.3.2. publishing, transmitting, disseminating, or storing content that infringes on the legal rights of others such as reputation, portrait rights, intellectual property rights, trade secrets, etc.
    • 4.2.3.3. falsifying facts or concealing the truth to mislead or deceive others.
    • 4.2.3.4. publishing, transmitting, and disseminating advertising information and spam.
    • 4.2.3.5. Engage in other acts that violate local laws and regulations.
  • 4.2.4. You are not allowed to conduct any commercial activities such as publishing advertisements or selling products on the Software without the permission of AMlink.

4.3. You understand and agree that:

  • 4.3.1. AMlink will determine whether the user is suspected of violating the above-mentioned usage rules and, based on the result of the determination, suspend or terminate your permission to use the website or take other restrictive measures that can be taken by this agreement.
  • 4.3.2. AMlink will directly delete any information that is suspected of violating the law or infringing on the legal rights of others or violating this Agreement that is published by users when using the Licensed Software.
  • 4.3.3. The user shall independently bear the legal responsibility in your name for any damage to third parties caused by the user's violation of the above-mentioned usage rules and shall ensure that AMlink shall be free from any loss or additional costs incurred as a result.
  • 4.3.4. If the user violates the relevant laws and regulations or the agreement and causes AMlink to suffer losses, or is subject to claims from third parties, or is punished by administrative authorities, the user shall compensate AMlink for the losses and/or costs incurred as a result, including reasonable attorney fees and investigation and evidence collection costs.

5. Service risks and disclaimer

5.1. Users must provide their own mobile terminal devices for Internet access and use of telecommunication value-added services, and bear their communication fees, information fees, and other related fees charged by their mobile terminal devices for Internet access or by third parties. If value-added telecommunication services are involved, we recommend that you confirm the relevant fees with your value-added telecommunication service provider.

5.2 AMlink and its partners shall not be responsible for any losses suffered by users due to third parties such as communication line failure, technical problems, network, mobile terminal equipment failure, system instability, and various other force majeure reasons.

5.3. The Software, like most Internet software, may be affected by various security problems, including but not limited to differences in user reasons, network service quality, social environment, etc., such as others using the user's information to cause real-life harassment; other software downloaded and installed by the user or other websites visited by the user contain "Trojan horses The user may download and install other software or visit other websites containing "Trojan horse" and other viruses that threaten the safety of the user's terminal device information and data, and then affect the normal use of the software. Users should strengthen their awareness of information security and user data protection and pay attention to strengthening password protection to avoid losses and harassment.

5.4. When users use the Software or request AMlink to provide specific services, the Software may call a third-party system or third-party software to support the users' use of access, and the use of access will be provided by the third party. AMlink does not guarantee the security, accuracy, validity, or other uncertainties of the service achieved through the third-party system or third-party software support.

5.5. AMlink especially draws users' attention to the fact that AMlink has the right to modify or discontinue the service at any time without notifying users to protect the company's autonomy in business development and adjustment, and AMlink is not responsible to users or any third party for exercising the right to modify or discontinue the service.

5.6. Except as expressly provided in-laws and regulations, we will do our best to ensure that the Software and the technology and information involved in it are secure, effective, accurate, and reliable, but subject to the limitations of available technology, the User understands that AMlink cannot guarantee this.

5.7. The user shall be liable for personal injury or incidental and consequential economic damages, including but not limited to loss of profits, loss of data, business interruption damages, or other business damages or losses, arising out of or in connection with any of the following.

  • 5.7.1. Use or failure to use the Licensed Software.
  • 5.7.2. Unauthorized use of the Software or alteration of the User's data by third parties.
  • 5.7.3. Costs and damages arising from the actions performed by the User with the Software.
  • 5.7.4. Misunderstanding of the software by users.
  • 5.7.5. Other damage related to the Software was not caused by AMlink.

5.8. All liability for any personal or financial injury or loss that occurs or may result from misleading or deceptive conduct between the user and other users of the Software through the Software shall be borne by the party at fault by law.

6. Description of Third-party Content and Services

6.1. Regardless of whether the third-party content or services are pre-installed in the Software or opened or subscribed by the user, the user understands and agrees that AMlink does not make any express or implied guarantee or warranty for the legality or validity of the third-party content or services provided or the user's actions, as well as the legality, accuracy, validity, and security of the third-party content or services.

6.2. AMlink does not supervise the third-party content or services, does not have any control over them, and does not provide any form of guarantee or warranty for the third-party services, nor does it assume any responsibility for them.

6.3. Any dispute or controversy between the user and the third-party content or service provider shall be resolved by the user and the third-party service provider through negotiation, and AMlink shall not be responsible for it.

7. Declaration of Intellectual Property Rights

7.1. AMlink is the owner of the intellectual property rights of the Software. All intellectual property rights of the Software, such as copyrights, trademarks, patents, trade secrets, and all information contents related to the Software (including but not limited to text, pictures, audio, video, graphics, interface design, layout frames, relevant data or electronic files, etc.) are protected by your local laws and regulations and the corresponding international treaties, and AMlink enjoys the above intellectual property rights.

7.2 Without the written consent of AMlink, the user shall not implement, utilize or transfer the above intellectual property rights for any commercial or non-commercial purposes by itself or license any third party, and AMlink reserves the right to pursue the legal responsibility for the above actions.

8. Agreement Changes

8.1. AMlink has the right to amend the terms and conditions of this Agreement when necessary, and once the terms and conditions are changed, the amended terms and conditions will be posted on the relevant page. If you do not agree with the changed content, you should cancel the service voluntarily. If the user continues to use the service, he/she shall be deemed to accept the changes to the terms and conditions of the agreement.

9. Other

9.1. When you use a particular service of the Software, there may be separate agreements and related business rules for that service (collectively, the "Separate Agreements"), and you should read and agree to the relevant Separate Agreements before using that service.

9.2. The headings of all provisions of this Agreement are for convenience only and have no actual meaning in themselves and shall not be relied upon for the interpretation of the meaning of this Agreement.

9.3. The remaining provisions of this Agreement shall remain valid and binding on the Parties, regardless of whether they are partially invalid or unenforceable for any reason.
